★ Massachusetts 2026 · Ballot Question 8

Question 8, explained: ending retail marijuana sales

Question 8 asks whether Massachusetts should end the recreational marijuana market voters created in 2016. It would close the stores. It would not make all marijuana illegal.

A yes vote

Repeals legal recreational sales and shuts down the licensed retail industry.

A no vote

Keeps recreational sales legal, as they are today.

Either way, adults 21 and over could still possess up to one ounce, and medical marijuana stays legal. A yes vote would also end growing marijuana at home.

What a yes vote does

  • Ends licensed recreational marijuana sales, along with the regulations and taxes built around them.
  • Ends home growing, now allowed up to six plants per adult.
  • Keeps possession of up to one ounce legal for adults 21 and over.
  • Leaves the medical marijuana system in place.

Where it stands now

Voters legalized recreational sales in 2016, and the first stores opened in 2018. Challenges to the question failed at the Supreme Judicial Court and the state Ballot Law Commission, so it is on your ballot. No state has ever repealed legalization once sales began.

The strongest case for each side

Both arguments, equal space

We don't tell you how to vote. Here is the best honest case each side makes.

The case for yes

Supporters argue commercial legalization has driven higher-potency products and more use, particularly among young people.

They point to documented harms, including cannabis use disorder and psychosis risk, and argue the state ran an experiment and should be willing to end it.

The case for no

Opponents argue repeal hands the market back to unregulated sellers with no product testing and no age checks.

They say it would wipe out substantial tax revenue and thousands of jobs in an industry the state licensed, and that with no state ever having done this, nobody knows what comes next.
